Victor Kaula’s practice includes domestic, regional, and international representation of clients before different courts, tribunals, and other fora. He has handled a blend of complex matters as the lead lawyer and as part of a team before the East African Court of Justice (EACJ), all levels of the Kenyan Courts, local tribunals and international tribunals such as the London Court of International Arbitration (LCIA). Victor has also represented clients before special committees of the Kenyan National Assembly and the Senate.

Previously, Victor served as an Associate in the Dispute Resolution Department of one of Kenya’s top firms, Macharia-Mwangi & Njeru Advocates. Before that, he served as a Legal, Risk & Compliance Officer at one of Africa’s leading leasing companies – Vehicle & Equipment Leasing Limited (VAELL).

His matters range from simple to complex commercial disputes, employment & labour disputes, constitutional & judicial (administrative) review matters, banking and commercial litigation, public procurement, insolvencies, insurance law, shareholder disputes, land matters and tax disputes. He also advises on diverse legal and regulatory compliance issues.

Aside from his legal practice, Victor provides training, writes, and speaks on a wide range of contentious issues. Victor has also served in the East African Community Youth Ambassadors Platform, as a Director – Youth Traineeships and Youths Development Programs at IYAAT, and as an Assistant Communications Director – Kenya Journal of Law and Justice.

  • Successfully representing the Attorney General of South Sudan before the East African Court of Justice (EACJ), the Kenyan Court of Appeal and the High Court in a claim by a private party of USD 50 million. Succesfully overturning a consent judgment and setting aside orders of attachment of the Government of South Sudan’s funds held in Kenyan banks and effectively lifting the freezing orders on the said accounts thereby enabling the Government of South Sudan to operate its accounts freely;
  • Stalwartly and successfully representing KCB Bank in the High Court and the Court of Appeal in an employment and labour relations claim against 23 employees claiming unfair termination of their employment through redundancy process;

  • Successfully defending Oshwal Academy Mombasa & Oshwal Academy Nairobi in a Constitutional matter for the alleged breach of consumer protection rights and violation of the Constitution and administrative procedures; setting aside conservatory orders issued against the schools and ensuring that the schools continue operations without interference during the subsistence of the novel COVID-19;
  • Successfully representing I&M Bank Limited as a secure creditor in the Insolvency Proceedings against Hi Plast Limited and obtaining leave to sell the security well as obtaining leave to file proceedings for the balance in excess of KES 1 Billion as against the guarantors and/or Directors of the insolvent company;
  • Successfully representing Jamii Bora Bank Limited (now Kingdom Bank (K) Ltd) in a landlord-tenant dispute in the High Court and the Court of Appeal for realization of rent in excess of KES 50 Million
  • Part of the team representing Cape Holdings Limited in the precedent-setting arbitral dispute against Synergy Limited; sucesfully defending the client against an award in excess of KES 7 Billion, effectively setting aside the award of the arbitrator before the High Court and defending the appeal in the Court of Appeal;
  • Part of the team representing a top Kenyan real estate developer in a construction dispute pitting it against a Kenyan construction company for a claim in excess of KES 700 Million; and
  • Part of the team representing a client in a claim before the LCIA in excess of KES 800 Million against a commercial paper issued by an East African supermarket chain and insured by a leading Kenyan insurance company.
